5 SONG EP PRODUCTION DEAL Terms & Conditions

*An independent investor has come to Advantage Music Production (AMP) seeking to invest in an up and coming band.   This investor chose AMP to produce this 5 SONG EP because of our proven track record of finding great talent, and producing quality, commercially viable productions in a timely manner.

Please understand that this is an investment venture for said investor, with the sole purpose of maximizing a return on this investment.  AMP and the investor believe that a production deal should be mutually beneficial for both parties (investor and band), and with our many years of experience, we feel this deal benefits both.  This production deal is designed for a band that has a strong potential for selling recorded music, but needs a financial jump-start getting songs recorded and put into a sellable package.  The band can then take the revenue they generate from the sale of the EP and use it to pay for recording more material (finishing a 10 song record for example).

By submitting an application for this 5 SONG EP PRODUCTION DEAL, you certify that you and your band members have each read and understood the terms and conditions below. If something in these terms and conditions is unclear, please feel free to contact us and get clarification. 

 

This is a music production deal only, and includes the producing of the musical tracks, and duplication of CD’s.  Marketing, promoting and selling the EP is the responsibility of the band.

The band is responsible for all travel expenses to and from Nashville, TN, including, but not limited to, food, transportation and lodging.

The resale price of the EP cannot exceed $8.00 on the band’s website or concert performance venue, or any other resale venue.

For the life of the EP, the band agrees to purchase from AMP all CD units of this EP at the price of $4.00/unit plus shipping, in quantity multiples of 120 units.

AMP owns the copyright to each song on the EP until 1000 units have been purchased, at which time the copyright owner title will be formally transferred to the band.  Upon transfer of copyright, AMP retains the exclusive right to duplicate the CD units.  If, at some point during the life of this EP, AMP or the band would like to terminate this exclusive right to duplicate the CD’s, the terms of the agreement will be renegotiated.

Any monies earned from digital sales of the EP, either individual tracks or otherwise, the band agrees to pay AMP 50% of the net revenue received.

1000 units must be purchased from AMP within 12 months of production completion, regardless of, but not limited to, the following: disbandment, loss of members, loss of concert performances, death, etc. at the unit price stated above.

In the event that the band defaults on purchasing 1000 units within 12 months, the balance due will roll into a loan to the undersigned band members, at an interest rate of 10% annually.

AMP reserves the right to package the final EP CD using whatever means appropriate, including, but not limited to, type of disc, coloring, graphic design, inserts, type of casing, etc.

AMP is free to use whatever means within their power to complete the 5 SONG EP PRODUCTION.  This includes, but is not limited to quality control, choosing the musicians, mastering house, mix engineer, graphic designer, etc.  AMP will do it’s best to seek approval from the band, however, AMP reserves final say in all matters related to the production and completion of this 5 SONG EP.
